1. Acceptance of Terms

By accessing or using GuaranteedCommission.com (the "Site"), you agree to be bound by these Terms of Use and our Privacy & Information Disclosure. If you do not agree, do not use the Site.

2. About the Service

GuaranteedCommission.com is a commission communication platform. It enables listed and FSBO property sellers to communicate buyer's agent compensation to the public. GuaranteedCommission.com has no affiliation with the multiple listing service (MLS), does not aggregate real estate data from the MLS, and is not a substitute for the MLS, or any website that aggregates real estate data from the MLS.

3. Eligibility; Accounts

You represent that you are at least 18 years old and have the authority to enter into these Terms. You are responsible for maintaining the security of your account and for all activity under your account.

4. Listings & Content

• You are solely responsible for the accuracy, legality, and completeness of any information you submit, including commission amounts, property details, photos, and contact information.
• You represent that you have all rights necessary to post the content and that it does not infringe third-party rights or violate applicable law.
• We may remove or decline to display content that we reasonably believe is inaccurate, misleading, illegal, or violates these Terms.

5. Payments & Upgrades

Some features are paid upgrades (e.g., Plus, Banner, Premium/Pin Placement, Confidential FSBO Upgrade). All purchases are final unless otherwise stated. Third-party payment processors (e.g., Stripe) may process your payments and their terms apply.

6. Advertising & Third-Party Professionals

• No Endorsement: GuaranteedCommission.com displays advertisements from third-party professionals (including "Local Professionals," "Local Brokers," and "Service Providers"). We do not employ, endorse, recommend, vet, or background-check these advertisers. Any interaction, transaction, or agreement between you and a third-party professional is solely between you and them. We are not liable for their acts, omissions, errors, representations, or negligence.
• Advertising Fees (RESPA Compliance): Fees paid by professionals are strictly for advertising display space (flat monthly or per-listing fees) based on ZIP code availability. These fees are not referral fees, kickbacks, or contingent on the success of any lead or transaction.
• Right to Remove: We reserve the right to reject or remove any advertisement or suspend any advertiser account at our sole discretion, immediately and without prior notice, if we suspect fraud, license suspension, consumer complaints, valid legal threats, or conduct detrimental to our brand.

7. Privacy

Our collection and use of personal information is described in our Privacy & Information Disclosure. FSBO sellers may optionally purchase the Confidential FSBO Upgrade as described there.

8. Prohibited Use

• Posting false, misleading, defamatory, or illegal content.
• Violating any law or third-party right, including privacy and intellectual property rights.
• Scraping, data mining, or reverse engineering the Site.
• Introducing malware, spam, or security exploits.

9. Intellectual Property

The Site and its content (excluding your content) are owned by or licensed to GuaranteedCommission.com and are protected by applicable laws. You may not copy, distribute, or create derivative works except as expressly permitted.

10. Disclaimers

The Site is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, and noninfringement. We do not guarantee sales results, showings, or outcomes.

11. Limitation of Liability

To the fullest extent permitted by law, GuaranteedCommission.com will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site.

12. Indemnification

You agree to indemnify and hold harmless GuaranteedCommission.com and its principals, officers, and agents from any claims, damages, liabilities, and expenses arising from your content or your use of the Site in violation of these Terms, and specifically including any claims arising from your professional services, your advertisements, or your interactions with consumers found through the Site.

13. Termination

We may suspend or terminate access to the Site at any time for any reason, including violation of these Terms. Upon termination, your right to use the Site ceases immediately.

14. Governing Law; Venue

These Terms are governed by the laws of the State of California, without regard to conflicts of law principles. You agree to the exclusive jurisdiction of state and federal courts located in Orange County, California.

15. Changes to Terms

We may modify these Terms from time to time. Updated Terms will be posted on the Site with a new "Last updated" date. Your continued use of the Site constitutes acceptance of the updated Terms.
